Terms of Service

These terms describe what KindredMind is, what it is not, what you agree to when you use it, and how to end the relationship if you ever need to.

Acceptance of terms

By creating a KindredMind account or using the KindredMind service, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the service. KindredMind is a product of Strong Ventures Inc., a company incorporated in Canada.

What KindredMind is

KindredMind is a voice-based phone companion designed for people living with dementia. The service uses a voice model built from a family caregiver's recordings to handle phone calls in a way that feels familiar to the person with dementia.

KindredMind is not a medical device, not a healthcare service, and not a substitute for professional medical, psychiatric, or emergency care. KindredMind is a supportive companion service. Always involve qualified healthcare providers in decisions about dementia care.

Who can use KindredMind

To use KindredMind you must be at least 18 years old and you must be the legally authorized caregiver, attorney for personal care, court-appointed guardian, or substitute decision-maker for the person with dementia who will receive the calls.

By creating an account you confirm that you have the authority to enroll the person with dementia in this service and to provide information about them, including their routines, preferences, and family details, as part of the knowledge base.

Voice cloning, acceptable use, and authorization

KindredMind builds a Personalized Voice Clone (PVC) from recordings provided by the account holder. By submitting voice recordings to KindredMind for the purpose of building a voice model, you represent and warrant the following:

  • The voice in the recordings is your own.
  • You are at least 18 years old and have full legal capacity to grant the rights described in these Terms and in our PVC consent form.
  • You are authorized to be cloned, including by any employer, union, agent, or other party with rights in your voice.
  • You have the right to authorize KindredMind to build a personalized voice model from those recordings and to use that model on outbound and inbound calls within KindredMind.

You may not submit voice recordings of any other person, living or deceased. Specifically, you may not submit recordings of:

  • Your loved one with dementia, or any other person who cannot meaningfully provide informed consent.
  • Public figures, celebrities, politicians, journalists, or any person whose voice is associated with a public role.
  • Any person you do not have explicit, contemporaneous, written authorization from.

KindredMind will never knowingly use a submitted voice to call any phone number or any individual that the voice owner has not personally authorized through their own KindredMind account. Voice models are tied to the account holder's account and may only be deployed against phone numbers the account holder controls or has verified authorization for.

If we suspect or discover that voice recordings were submitted without the appropriate authorization, we will immediately suspend the account, delete the voice model and underlying recordings, and may terminate the account.

Outbound telephone use, anti-spam, anti-fraud

If KindredMind initiates outbound calls on your behalf at your request, you are responsible for ensuring those calls comply with all applicable telephone communication laws in your jurisdiction, including the Telephone Consumer Protection Act (TCPA) in the United States, Canadian Radio-television and Telecommunications Commission (CRTC) rules in Canada, and any federal, state, provincial, or local Do-Not-Call rules. You are responsible for obtaining all legally required consents from the call recipients before any outbound call is placed, for checking applicable Do-Not-Call registries, and for honouring any request to stop calling.

KindredMind is designed to handle calls between a family caregiver's voice companion and one specific person living with dementia in that caregiver's life. KindredMind is not a marketing, sales, telemarketing, robocall, political messaging, or survey platform.

By using KindredMind you agree that you will not:

  • Use the service to make unsolicited marketing, sales, fundraising, political, or survey calls.
  • Use the service to contact anyone who has not consented to receive calls from a KindredMind voice companion through your account.
  • Use the service in a manner that violates the Telephone Consumer Protection Act (TCPA), Canada's Anti-Spam Legislation (CASL), Canada's Unsolicited Telecommunications Rules, or any other applicable telecommunications law.
  • Use the service to impersonate any person, business, government agency, or organization with intent to deceive, defraud, harass, or cause harm.
  • Use the service to attempt unauthorized access to any account, device, or telephone number.
  • Use the service for the deceptive imitation of a third party's voice for harassment, fraud, social engineering, or any other unlawful purpose.

KindredMind monitors for patterns indicative of abuse, including spikes in outbound call volume, unusual call destinations, and patterns suggestive of mass calling, telemarketing, or fraud. We reserve the right to suspend an account immediately, without prior notice, if we reasonably believe it is being used in violation of these rules.

Your responsibilities as the caregiver

You are responsible for:

  • Providing accurate information about your loved one for the knowledge base.
  • Recording voice samples that meaningfully represent your voice.
  • Reviewing call summaries and updating the knowledge base as your loved one's needs change.
  • Maintaining the confidentiality of your account credentials.
  • Ensuring KindredMind is appropriate for your loved one's specific situation, in consultation with their healthcare providers if needed.
  • Promptly notifying us if your loved one passes away, enters palliative care, or moves to a level of care where the service should be paused.

Service availability

We work hard to keep KindredMind running but we cannot guarantee 100% uptime. Telephone networks, internet services, and AI providers occasionally experience outages. KindredMind includes an emergency failsafe system that routes calls to your phone if our AI service is unavailable, but this depends on your phone being reachable. Do not rely on KindredMind as the sole means of communication with your loved one in an emergency.

Pricing and payment

KindredMind is offered through monthly or annual subscription plans. Current pricing is available at kindredmind.care. We may change pricing for new subscribers at any time. Existing subscribers will be notified at least 30 days before any price change takes effect.

Subscriptions are billed in advance. If you cancel, your service will continue until the end of the current billing period and will not renew. We do not provide refunds for partial months or unused time, except as described in our Refund Policy. Refunds outside of the published Refund Policy are at our sole discretion.

Some plans include usage limits. If you exceed those limits we will notify you and provide options for upgrading or adding capacity.

Termination, account closure, and voice deletion

You may close your KindredMind account at any time from your account settings. If you close your account or cancel your subscription:

  • Your access to the service ends at the end of your current billing period.
  • We will permanently delete your knowledge base, call summaries, transcripts, account information, and personalized voice model within 30 days of account closure.
  • We will permanently delete the underlying voice recordings used to build your voice model.
  • We will retain your signed PVC consent record, including the exact consent text you agreed to, the date and time, your IP address, your user agent, and the email address on your account at the time of signing, for compliance and audit purposes only.

We may suspend or terminate your account if we reasonably believe you have violated these terms, if you fail to pay for the service, or if continued operation creates legal, security, or operational risk for us, your loved one, or other users. If we terminate your account for cause, we will notify you by email and explain the reason.

On termination, our undertaking to delete your voice model and underlying recordings applies the same way it does for a voluntary account closure.

Intellectual property

The KindredMind service, including the software, design, content (excluding your data), and brand name, is the property of Strong Ventures Inc. and is protected by copyright and trademark law.

Your data, including your voice recordings, voice model, knowledge base, and call data, belongs to you. We have a limited license to use it solely for the purpose of providing KindredMind to you and your loved one.

Disclaimers

KindredMind is provided on an as-is and as-available basis. We do not warrant that the service will be uninterrupted, error-free, or perfectly suited to your loved one's specific needs.

Voice models are sophisticated, but they are not perfect. The companion may occasionally produce responses that are unexpected, awkward, or that do not perfectly match your speaking style. We continuously work to improve quality but cannot guarantee any specific outcome.

KindredMind is not a substitute for human caregivers, healthcare providers, or emergency services. Always involve appropriate professionals in your loved one's care.

Limitation of liability

To the maximum extent permitted by law, Strong Ventures Inc. and its officers, employees, contractors, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of KindredMind, including but not limited to damages for emotional distress, loss of relationship, loss of data, or business interruption.

Our total cumulative liability for any claim arising from these terms or your use of the service shall not exceed the greater of (a) the amount you paid for the service in the 12 months before the claim arose, or (b) one hundred Canadian dollars.

Indemnification

You agree to indemnify and hold harmless Strong Ventures Inc. from any claims, damages, or expenses arising from your violation of these terms, your misuse of the service, your unauthorized provision of voice recordings, your use of the service to contact any person without their consent, or your provision of inaccurate information about yourself or your loved one.

Governing law and disputes

These terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable in Ontario. Any dispute arising from these terms or your use of KindredMind will be resolved in the courts of the Province of Ontario.

If you are a consumer located outside of Canada, you may have additional rights under your local consumer protection laws that cannot be waived. Nothing in these terms is intended to limit those rights.

Changes to these terms

We may update these terms from time to time. If we make material changes, we will notify you by email at least 30 days before the changes take effect. Continued use of KindredMind after the effective date constitutes acceptance of the updated terms.
